Please note: Kathryn Raymond is available to arbitrate or mediate disputes in a healthcare, hospital, long term care or medical malpractice context on a national basis but otherwise restricts her practice to Atlantic Canada.

As a member of the arbitral and mediator community, Kathryn Raymond resolves disputes in both the private and public sectors. This includes labour relations arbitrations through Ministerial appointment under the Nova Scotia Trade Union Act and through appointment as a Board of Inquiry for purposes of adjudicating complaints of discrimination pursuant to the Nova Scotia Human Rights Act. Kathryn has extensive experience as neutral counsel to adjudicative and investigative tribunals in a professional regulation and healthcare context. Her areas of interest include both regulated and consensual dispute resolutions design and improving ADR processes for unionized and non-unionized workplaces, for the healthcare sector, and for professional groups.

Kathryn has a strong background in health law, administrative law, employment law, labour relations and professional regulation. A native of Yarmouth, Nova Scotia, Kathryn was first called to the bar in Ontario in 1987 and practiced in Toronto in both the private and public sector, first in personal injury litigation representing both Plaintiffs and insurers and later as Legal Counsel with the Ontario Ministry of Health. She was called to the bar in Nova Scotia in 1990 and became a senior partner with Boyne Clarke and Chair of the firm’s Health, Employment, Administrative and Labour Law Team.

Kathryn has over 20 years experience in the regulated health care sector, in particular. In addition to her role as neutral counsel to tribunals in professional disciplinary context, she has acted as an advocate for all parties to such proceedings, representing the interests of patients, administration and professionals. Her comprehensive knowledge of disputes in the healthcare sector includes those involving physician privileges, contractual issues and licensing, professional negligence, allegations of disruptive behaviour, patient/client complaints involving professional and clinical staff, as well as Board governance and intra-management disputes. This includes disputes with a potential direct impact on patient safety or the delivery of care and those with administrative impacts.

Kathryn’s experience in resolving workplace disputes draws upon her negotiation skills and knowledge of litigation, as well as the perspective she gained representing the interests of both employers and employees. Her experience includes matters involving employment law, human rights, labour law, harassment and privacy.

In resolving civil disputes, Kathryn draws upon her knowledge of disabilities, negligence, including medical malpractice, insurance, contract, policy and statutory interpretation. Kathryn works with the parties to customize an approach that best meets their needs, providing rights and interest based mediation, med-arb and arbitration services.

Kathryn has been consulted by government and stake holders in the drafting of various statutes and speaks frequently on topics which include dispute resolution, administrative law, employment/labour law, and health law with an emphasis on procedural fairness and interest-based resolutions.

Active in her community, Kathryn’s current commitments include chairing the Nova Scotia Barristers’ Society Ethics and Professional Responsibility Committee, chairing the Governance Committee of the Mental Health Foundation of Nova Scotia, and her work on the Board of the Nova Scotia Health Organizations Protective Association.
